I took the advice of my Executive Council on

the question of the carrying out of the sentence in the

event of leave to appeal being refused, or of the appeal being dismissed, and they unanimously advised that the

sentence should be carried into effect.

I should like to draw special attention to

the remarks made by the Chief Justice at the beginning of his summing up as reported on pages 323 and 324 of the Hongkong Weekly Press of the 25th March. It is undoubtedly

the fact that in many instances in Hongkong entirely

fictitious cases are presented, complete in every detail,

and involving the most deliberate and carefully prepared perjury. This is unfortunately a feature of litigation in this Colony, and the problem of how to deal with the evil, and with the class of persons responsible for it, has on more than one occasion engaged the attention of the Government, but so far no solution has been discovered. 11. I am reporting this case in considerable detail. I am doing so because I think that it is important that anyone who may have to deal with the case on behalf of the Crown should appreciate both its seriousness and its

gemineness.
